Rent arrears — rent that is owed but has not been paid — create immediate financial stress and require prompt, systematic response. Ontario's legal framework provides remedies for landlords, but the process requires adherence to specific procedures to be effective.

The first response to missed rent is direct communication with the tenant. Sometimes missed rent is a simple oversight or temporary emergency that a direct conversation resolves quickly. Document the communication and confirm any payment arrangement in writing before concluding that formal proceedings are necessary.

Key Responsibilities and Best Practices

Serving an N4 notice (Notice to End Tenancy for Non-Payment of Rent) is the formal first step. The N4 must state the exact amount of arrears, the termination date (14 days from service), and must use the current prescribed form. Errors in the amount or form invalidate the notice and require restarting the process.

Filing an L1 application at the LTB triggers the formal process for both eviction and rent collection. The L1 asks the LTB to order eviction and issue a money order for the arrears. If the tenant pays before the hearing, the eviction portion is moot, but you can proceed on the money order for any remaining arrears.
