N12 Eviction in Ontario: A Complete Landlord Guide

Personal use eviction is one of Ontario's most regulated and contentious eviction grounds. What landlords need to know before proceeding.

The N12 notice — Notice to End Tenancy Because the Landlord, Purchaser, or a Family Member Requires the Unit — is one of the most powerful but also most scrutinized tools available to Ontario landlords. Used in good faith, it allows landlords to reclaim their property. Used improperly, it carries severe consequences.

Qualifying grounds for an N12 include: the landlord (or their spouse, child, parent, or caregiver) intends to occupy the unit; or a purchaser (or their family member) intends to occupy the unit after sale. The intent must be genuine and the person must actually intend to occupy the unit for at least 12 months.

Key Responsibilities and Best Practices

The notice requirements are precise. The N12 must be served with at least 60 days' notice, must expire on the last day of a rental period, and must identify which person intends to occupy and their relationship to the landlord. Any error in these details can invalidate the notice.

Compensation is mandatory when serving an N12. The tenant is entitled to one month's rent as compensation for being displaced. This must be provided on or before the termination date in the notice. Failure to provide compensation is a complete defence to the eviction at the LTB.
