LTB Hearing Preparation: How to Present Your Case Effectively

Being prepared for your LTB hearing improves outcomes. Here's how to prepare for a successful presentation.

Tenant Management Essentials

The Landlord and Tenant Board hearing process is administrative, not a formal court proceeding — but preparation matters significantly. Well-prepared, organized landlords achieve better outcomes than those who show up unprepared.

Organize your evidence before the hearing. For an L1 (arrears) application, your evidence should include: a copy of the signed lease, documented rent payment history (showing each payment received and dates), the N4 notice with proof of service, and a current rent roll showing amount owing.

Screening and Placement

Proof of service documentation is critical. You must be able to demonstrate that required notices were properly served to the tenant. The method of service (personal delivery, mail, posting) has specific requirements under the RTA — confirm compliance.

Witnesses should be arranged in advance if they'll be needed. For cases involving property damage, harassment, or other complex facts, witnesses who can corroborate your position strengthen your case.

Retaining Quality Tenants

Prepare a clear, factual timeline of events. LTB adjudicators process many cases; a concise, organized presentation of relevant facts is more effective than a rambling narrative. Stick to facts directly relevant to the issue.

Know what remedy you're asking for. Be specific about the order you want: arrears amount, whether you're seeking standard or expedited enforcement, and any additional terms. Vague requests produce vague orders.

Approach the hearing professionally. Adjudicators observe how parties conduct themselves. Professional demeanour, factual presentation, and respectful interactions (even with an adversarial tenant) reflect well and contribute to credibility.
