Tenant's Notice to Vacate: What Landlords Need to Know When a Tenant Plans to Leave

When a tenant gives notice to vacate, a smooth transition depends on clear communication, proper documentation, and prompt action on re-marketing the unit.

A tenant ending a month-to-month tenancy must give at least 60 days written notice, with the notice expiring on the last day of a rental period. If the tenancy is monthly with rent due on the first, a tenant giving notice on March 15 must give notice to expire no earlier than May 31.

Screening and Placement

The N9 (Tenant's Notice to Terminate the Tenancy) is the prescribed form but is not mandatory — tenants can give written notice in any form. What's required is that the notice be in writing, give the correct notice period, and specify the termination date. Verbal notice is not binding.

A tenant in a fixed-term lease cannot terminate early without the landlord's agreement unless specific circumstances apply (domestic violence, landlord's persistent harassment, or the unit becomes uninhabitable). If a fixed-term tenant tries to vacate early without cause, the landlord can hold them responsible for rent until the end of the term or until a replacement tenant is found.

Retaining Quality Tenants

Response protocol when a tenant gives notice: Confirm receipt of the notice in writing. Schedule a pre-vacate inspection to identify repairs needed before re-marketing. Begin the re-marketing process immediately — vacancy between tenancies is the largest cost event in property management. Plan a detailed move-out inspection for the final days of the tenancy.

Security of tenure protects tenants from being required to leave at the end of a fixed-term lease. A fixed-term lease in Ontario automatically converts to a month-to-month tenancy at expiry unless either party gives proper notice. The tenant is not required to sign a new lease at the end of the term.
