After serving an N4, the L1 is the next step toward eviction for non-payment of rent — understanding the process prevents procedural dismissals that restart the clock.

An L1 Application to Evict a Tenant for Non-payment of Rent can be filed with the Landlord and Tenant Board after a properly served N4 expires without the tenant paying or vacating. The L1 can be filed the day after the N4 termination date.

Key Responsibilities and Best Practices

The L1 application requires: the completed L1 form, a copy of the N4 that was served, and the filing fee (currently $201 for LTB applications). Applications are filed online through the LTB e-file system, and confirmation is provided once the application is received.

After filing, the LTB sets a hearing date. Historically, hearing wait times varied widely across different LTB locations. The shift toward virtual hearings has reduced wait times somewhat, but landlords should plan for 4 to 8 weeks from filing to hearing in most circumstances.

At the hearing, the landlord must prove: that a valid tenancy exists, that rent was owed in the amount claimed, that a valid N4 was served correctly, and that the rent remains unpaid. The tenant has the opportunity to dispute any of these elements or request relief from eviction.

The LTB adjudicator has broad discretion to order payment, set a payment plan, or order eviction depending on the tenant's history, the amount owed, and any hardship factors presented. A landlord who can demonstrate a pattern of chronic late payment has a stronger case for outright eviction than one whose tenant is experiencing a one-time hardship.
