Tenant Rights in Ontario: What Every Landlord Must Know

Understanding tenant rights is not just legal compliance — it's the foundation of effective landlord-tenant relationships that reduce disputes and LTB proceedings.

Right to privacy: tenants have the right to exclusive possession of their rental unit. Landlords may not enter without 24 hours written notice specifying the reason and time of entry, except in genuine emergencies. This right applies even if the landlord owns the property outright — ownership does not override the tenant's right to peaceful occupancy.

Screening and Placement

Right to maintenance: tenants have the right to a rental unit that is maintained in a good state of repair and fit for habitation. This standard is objective, not based on the rent amount paid. A below-market rental unit has the same maintenance standards as a premium unit.

Right to privacy from harassment: the RTA prohibits landlord harassment, which includes unreasonable entry, persistent phone calls or messages, threats of eviction, interfering with essential services, and other conduct that substantially interferes with the tenant's reasonable enjoyment. Harassment findings result in significant LTB orders.

Retaining Quality Tenants

Right to sublet: tenants in fixed-term leases have the right to sublet with the landlord's consent, which cannot be unreasonably withheld. The original tenant remains responsible under the lease; the subtenant's relationship is with the original tenant, not the landlord. Assignment (transferring the lease entirely to a new tenant) requires consent and the landlord can decline if they have a valid reason.

Right to an N1 (notice of rent increase): before any rent increase can take effect, the landlord must serve a properly completed N1 form at least 90 days before the effective date. An increase attempted without proper notice is void and unenforceable, and the landlord must restart the process.
