The N5 is Ontario's notice for tenants who interfere with others, damage property, or overcrowd a unit — getting the process right is critical to a successful LTB application.
An N5 (Notice to End your Tenancy For Interfering with Others, Damage or Overcrowding) is served when a tenant damages the rental unit, interferes with the reasonable enjoyment of other tenants or the landlord, causes overcrowding, or allows illegal activity. Unlike the N4, the N5 gives the tenant an opportunity to void the notice.
Key Responsibilities and Best Practices
The first N5 gives the tenant 7 days to correct the behaviour or pay for damages. If the tenant corrects the issue within this void period, the notice is cancelled and cannot be used as the basis for an L2 application. If the tenant does not correct the issue — or corrects it and then repeats the behaviour within 6 months — the landlord can proceed to the LTB.
A second N5 within 6 months is non-voidable. The tenant has no opportunity to correct the issue; the landlord can file an L2 Application immediately after the second N5 is served. This two-notice system is why documentation of the first incident is critical — you need a clear record showing the first notice was served and the timeline.

The N5 must specify the alleged act or omission in enough detail that the tenant knows exactly what they need to correct or stop. A vague N5 that says only 'disturbing neighbours' without dates, descriptions, or documented complaints is vulnerable to challenge at a hearing. Attach supporting documentation — noise complaint logs, photos, written complaints from other tenants.
Landlords sometimes confuse the N5 and the N7. The N7 is used for impairment of safety — a tenant who creates conditions that seriously endanger the safety of others. The N7 has a shorter notice period and is non-voidable, but requires a higher threshold of evidence. Use the correct form for the situation.
