Ontario Fire Code requirements for rental properties are extensive — violations result in orders, fines, and potential personal liability if an incident occurs.

Smoke alarms are required on every storey of a dwelling unit and outside all sleeping areas. In properties with multiple units, additional requirements apply for interconnected or combined systems depending on building type and occupancy. Battery-powered smoke alarms must be replaced within 10 years of the manufacture date printed on the unit.

Ontario Tenancy Law

Carbon monoxide alarms are required adjacent to every sleeping area in a dwelling unit that contains a fuel-burning appliance (gas furnace, gas water heater, gas stove) or an attached garage. CO alarms must also be replaced within 7 to 10 years of manufacture (check the product specification).

Fire extinguisher requirements vary by building type and occupancy. Multi-unit residential buildings above a defined size require commercially-rated and regularly serviced extinguishers in specified locations. Single-family rentals are typically not Code-required to provide fire extinguishers, though many landlords choose to as a reasonable safety measure.

Protecting Landlord Rights

Means of egress requirements: every sleeping room must have at least one window that provides adequate escape in case of fire (see egress window specifications). All required exit routes from the building must be maintained clear of obstructions at all times — a tenant storing items in a common corridor that reduces exit width is in violation of Fire Code.

Fire inspection compliance: Kitchener, Waterloo, and Cambridge fire departments conduct inspection programs for rental housing. Properties subject to inspection must demonstrate Code compliance or face orders for correction within a specified timeframe. Repeat violations can result in charges under the Fire Prevention and Protection Act.
