Accessible rental units are in short supply across Ontario — understanding your legal obligations and the market opportunity helps landlords serve this underserved segment.
Human rights obligations prevent landlords from refusing to accommodate tenants with disabilities. The Ontario Human Rights Code requires landlords to accommodate a tenant with a disability up to the point of undue hardship. This may include allowing mobility aids, permitting a service animal where pets are otherwise restricted, or making modifications to allow access.
Ontario Tenancy Law
Tenant-requested modifications: a tenant with a disability may request permission to modify the unit to accommodate their needs. The landlord may require that the modifications be made by a qualified contractor, that the changes be permitted under the lease, and that the unit be restored to its original condition on vacating. The landlord cannot refuse a reasonable modification request.
Accessibility features that increase marketability: properties with step-free entry, wider doorways (minimum 810 mm clear), lever hardware, roll-under accessible sink space, and accessible shower configurations serve a significantly underserved rental market. In Kitchener-Waterloo, accessible units for tenants using mobility devices are particularly scarce.
Protecting Landlord Rights
Financial incentives for accessible housing modifications exist at both federal and provincial levels. The Federal Enabling Accessibility Fund and various provincial programs provide grants for accessibility modifications in rental housing. These programs change periodically — check the current availability through the CMHC and Ontario Ministry of Municipal Affairs.
Accessible parking requirements: if your rental property has parking, accessible spaces must be provided at the ratio required by Building Code for the property type. Retrofitting accessible spaces in an existing parking area is a legitimate accommodation request that landlords should be prepared to address.
